This is the first bail application on behalf of the applicant Subhash Dhaka in connection with Case Crime No. 210 of 2024, under Sections 103(1), 109, 62(2) B.N.S., Police Station Chandi Nagar, District Baghpat. Heard Mr. Ajay Kumar Vashistha learned Counsel for the applicant and Mr. Virendra Kumar Shukla, learned State Law Officer, appearing for the State. The submission of learned Counsel for the applicant is that the prosecution case is based on direct evidence but applicant is not named in the F.I.R. nor in the statements of the injured witness recorded under Section 161 Cr.P.C. His name was figured much later in the statement of an eye witness Jai Kumar, who said that the applicant too was present in the village when the crime happened and is part of the conspiracy.
