Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material on record. 2. The present bail application has been filed on behalf of the applicant in case crime No. 447 of 2024, under Section - 8/15/29/37 N.D.P.S. Act, Police Station - Gangoh, District - Saharanpur, with the prayer to enlarge the applicant on bail. 3. It has been argued by learned counsel for applicant that the applicant is innocent and he has been falsely implicated in this case. As per prosecution version, police have conducted a raid at a semi-constructed house and huge quantity of poppy straw was recovered and that applicant and co-accused Faizan were arrested at the spot. Learned counsel submitted that there is no independent witness of the alleged recovery and that mandatory provisions of N.D.P.S. Act have not been complied with.
