Mr.Rohit Shukla, learned advocate appears on behalf of applicant and submits that the accused-Pushpendra has been falsely implicated in Case Crime No.200 of 2024 under Sections 115 (2), 103(1) BNS registered at Police Station-Gagalhedi, District-Saharanpur and is languishing in jail since 28th September, 2024. It is the contention of learned counsel that the informant-Om Pal is not the eye-witness, who has lodged the FIR on the basis of information gathered. It is further contended that two eye-witnesses, namely, Kuldeep and Arun, who were owner and shopkeeper of the liquor-shop before whom the incident occurred, have belied from their statement under Section 161 Cr.P.C. in their examination before the court.
