Learned counsel for the applicant submits that the applicant is the husband of the informant and has been falsely implicated in the instant case. The incident was alleged to have occurred on 25.09.2023. The first information report was lodged on 20.10.2023. The delay is fatal to the prosecution case. The ultrasonography report as well as statement of the doctor does not establish that miscarriage of the unborn child was caused due to assault on 25.09.2023.
