The instant bail application has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 65 of 2025, under Sections 318(4), 61(2) of B.N.S. and Sections 8(2)(3), 11(3), 13(5) of Uttar Pradesh Public Examination (Prevention of Unfair Means) Act 2024, Police Station- Kaptanganj, District- Azamgarh. 3. Counsel for the applicant submits that the applicant has been falsely implicated in the instant case. The incident was alleged to have occurred on 11.03.2025 at 10:00 A.M. The first information report was lodged at 20:36 hours i.e. 08:36 P.M. The delay in lodging the F.I.R. is fatal to the prosecution case.
