Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. The present bail application has been filed by the applicant involved in Case Crime No. 185 of 2024, under Section - 3(1) U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, Police Station - Chetganj, District - Varanasi, with the prayer to enlarge the applicant-accused on bail. 3. Learned counsel for the applicant-accused argued that applicant is innocent and he has been falsely implicated in this case. In Gang chart four cases have been shown against applicant and the same are not heinous in nature. In the cases shown in Gang Chart, applicant-accused has already been granted bail. Referring to facts of the matter, it was submitted that there is no credible evidence to show that applicant– accused falls within the ambit of Gangster.
