Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. The present bail application has been filed on behalf of the applicant in Case Crime No. 454 of 2024, under Section - 8/20 of N.D.P.S. Act and Sections - 318, 338, 336, 340 BNS, Police Station - Mahrauni, District - Lalitpur, with the prayer to enlarge the applicant on bail. 3. It is submitted by learned counsel for applicant that applicant is innocent and he has been falsely implicated in this case. As per prosecution version recovery of 28 kg illicit 'ganja' was shown from the applicant and co-accused Shubham Yadav. There is no independent witness of the alleged recovery and that mandatory provisions of N.D.P.S. Act, including Section 50 of the N.D.P.S. Act, have not been complied with.
