This Application has been filed under Section 11 of the Arbitration and Conciliation Act, 1996 ( “the Act”), seeking appointment of an arbitrator in connection with disputes and differences that are said to have arisen between the parties under an agreement dated March 31, 2016 (“Development Agreement”). There is no dispute that the agreement contains an arbitration agreement. The Applicant is the developer in the said agreement, while the Respondent is the Cooperative Housing Society whose property was meant to be redeveloped. 3. The Respondent terminated the Development Agreement by a notice dated June 30, 2021. This led to the Applicant invoking arbitration by a notice dated August 12, 2021.
