The O.A. is pending before the Tribunal. The application for modification of the order passed on 20.07.2022 which has come to be rejected by the Tribunal has given rise to the present writ petition. 3. Though, the O.A. is pending, wherein the petitioner has already filed a counter affidavit, nevertheless, the interlocutory has been assailed without any just cause. Interlocutory issues of this nature cannot be entertained under Article 226 of the Constitution of India, unless there are compelling circumstances which is not the case at hand. 4. Once the counter affidavit has been filed before the Tribunal, it is expected that the Tribunal shall proceed with the matter and decide the O.A. finally.
