(2) By means of the instant writ petition, the petitioners have assailed the judgment/order dated 19.07.2023 rendered by State Public Services Tribunal, Lucknow in Claim Petition No.1200 of 2018, whereby the claim petition filed by the respondent herein for recovery of a sum of Rs.97,971/- has been allowed. (3) Undisputedly, the charge-sheet was issued against the respondent prior to his retirement under Rule 7 of U.P. Government Servant (Discipline and Appeal) Rules, 1999 [here-in-after referred to as 'the Rules 1999'] i.e. for a major penalty. During the pendency of the disciplinary proceedings, the respondent is stated to have attained the age of superannuation. Consequently, the disciplinary proceedings which were instituted prior to his retirement continu
