The learned counsel for the appellants submits that the learned Single Judge while passing the impugned order dated 05.10.2006 followed the judgment in Prabhu Narain Sharma and others Vs. State of U.P. and others : Writ Petition No. 5505 (S/S) of 1999, decided on 26.08.1999 at Lucknow Bench. 4. The said judgment in the case of Prabhu Narain Sharma (supra) has been reversed by the Division Bench in State of U.P. and others Vs.
