Delay in filing the appeal is condoned. 4. Learned counsel for the respondent submits that issue, as raised in the present appeal, is squarely covered by the decision of this Court in State of U.P. Thru. Principal Secretary, Revenue Department, Lko. & 3 others v. Jag Prasad Chaubey (Special Appeal No. 191 of 2024 decided on 6.09.2024), whereby intra court appeal of similar nature has been dismissed by a co-ordinate Bench of this Court. 5. Counsel for the appellants is not in a position to dispute the same. 6. In view thereof, for the reasons indicated in the case of Jag Prasad Chaubey (Supra), the present appeal is also dismissed. .
