These two Appeals are decided by this common Judgment because they arise from the same Sessions Case. The Appellant Rajendra Shankar Raut in Criminal Appeal No.494 of 2020 was the original accused No.1 and the Appellant Harichandra @ Hari Motiram Pawar in Criminal Appeal No. 295 of 2020 was the original accused No.2 in Sessions Case No.29 of 2014 before the learned Additional Sessions Judge-3, Nashik. The learned Judge, vide the Judgment and order dated 06.02.2020 convicted and sentenced the Appellants as follows: The Appellant Rajendra Shankar Raut was convicted and sentenced as follows: i) He was convicted for commission of the offence punishable U/s.302 of the I.P.C. and was sentenced to suffer life imprisonment without remission and to pay a fine of Rs.10000/- and in default to suffer R.I. for two years. ii) He was convicted for commission of
