The present PIL has been filed with the following prayer : "Issue a writ, order or direction in the nature of MANDAMUS thereby commanding and directing the opposite parties to remove the illegal encroachments on the water channels for irrigation bearing Survey No. 425 area 0.0300 hectare and Survey No. 437 area 0.0170 hectare situated in the Village- Chitaipatti, Pargana-Surhurpur, Tahsil- Jalalpur, District- Ambedkar Nagar contained in ANNEXURE No.1 to the writ petition." 3. The counsel for the State, based upon the instructions, which is taken on record, states that actually there are no encroachment, however if the petitioner is said to be aggrieved, he may move appropriate application under the U.P. Revenue Code, which shall be dealt with in accordance with law
