That it is further stated that the disputed chak road is now constructed and situated over bhumidhari land of Gata No. 70 belonging to Shiv Kumar, and public passage is smoothly operational on the same. 9. That it is also submitted that aforesaid fact has been admitted by the petitioner himself, who has submitted photographs showing the construction of the road. However, it is humbly submitted that the said fact was not mentioned in the earlier affidavit of the deponent, due to which this Hon'ble Court was pleased to direct the deponent to file a better affidavit."
