This petition, purportedly in public interest, has been filed by the petitioner-Trust seeking removal of illegal encroachment over the pond and Suryakund Dham Temple situated in District Gorakhpur. 2. A perusal of the petition and the reliefs claimed, indicates that the petition has been filed in relation to the property claimed to be that of the temple. 3. Once the property claimed to be that of a temple and qua the respondents, there have been litigations/old litigations, filing of the present petition in the nature of public interest, cannot be countenanced. 4. The petition is, therefore, dismissed, leaving it open for the concerned to take appropriate proceedings in accordance with law.
