First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 439 of the Code of Criminal Procedure, 1973) has been filed on behalf of Petitioner – Pardeep Pradhan for grant of Regular Bail in FIR No. 0461/2021 dated 19.11.2021 under Section 364A/392/397/412/34 of the Indian Penal Code, 1860 (hereinafter referred to as „IPC‟) and Sections 25/27/54/59/30 of Arms Act, registered at Police Station Paharganj. Briefly stated, the Bail Application filed before the learned ASJ had been dismissed vide Order dated 04.04.2025. It is submitted that the Applicant is an Accused and not a convict. The over-arching postulate of criminal jurisprudence that the Accused is presumed to be innocent unless proven guilty, cannot be brushed aside lightly howsoever stringent the penal law may be. It is submitted that due to lack of post-operative palliative care, the Applicant’s mother is experiencing complications in her operated eye.
