No.252 of 2010, arising out of Case Crime No. 1555 of 2009, under Section 2/3 Gangster Act, Police Station Kotwali, District Gorakhpur. 2. Learned counsel for the accused-applicant, contends that there is criminal history of ten cases against the accused-applicant, which is duly explained in the bail application as well as supplementary affidavit. The explanation of criminal history shows that in two cases, the accused is acquitted; in six cases bail has been granted; one case of Section 110 Cr.P.C. has been dropped and in one case, no charge sheet has been submitted. As such, he prays that the accused/applicant be enlarged on bail. 3. Learned A.G.A. has opposed the prayer for bail but could not dispute the aforesaid facts. 4.
