The present bail application has been moved by the applicant-accused Shoeb for the offence punishable under Sections 21/22 of N.D.P.S. Act, 1985 in Case Crime No.794 of 2024, Police Station- Kasganj, District-Kasganj. 3.Mr. Ali Hasan, learned advocate, appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case on the basis of tip off. Arrested the accused from the public place. Seized 650 gms of Diazepam from the pocket of accused-applicant. Learned counsel for the applicant submits that it is a false implication. The arrest and recovery of the accused has not been made in the presence of independent witness. The mandatory provision of Section 50 N.D.P.S. Act has not been complied.
