The present bail application has been moved by the applicant- accused Aabul Hasan for the offence punishable under Sections 8/21 of N.D.P.S. Act, 1985 in Case Crime No. 496 of 2024, Police Station- Katghar, District-Moradabad. 2.Mr. Shoab Qumar Khan, learned advocate, appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case, wherein 30 Injection of Buprenosphine IP0.3 mg/ml Blugesic weighted 60 gms. has been recovered from the possession of the accused-applicant. The arrest and recovery of the accused has not been made in the presence of independent witness. The mandatory provision of Section 50 N.D.P.S. Act has not been complied. There are criminal history of three cases to the credit of the accused-applicant excluding the present one. The criminal history has been explained by the accused and in all the cases, he is on bail.
