The present bail application has been moved by the applicant-accused Sarif for the offence punishable under Sections 8/20 of N.D.P.S. Act, 1985 and Section 318(4) of B.N.S. in Case Crime No. 1185 of 2024, Police Station- Highway, District-Mathura. 2. Mr. Kartikey Singh, learned advocate, appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case. The accused applicant was a gratutious passenger in the car driven by co-accused. The police on the basis of tip off intercepted the car and got recovered 140 kg Ganja from the car. There is no criminal history. The arrest and recovery has been made in absence of independent witness. 3. Per contra, learned AGA opposed the bail and submits that charge sheet has been submitted in this matter. 4. Taken into consideration the rival submissions made by the parties and perused the record. 5. It is settled position of law that
