The present bail application has been moved by the applicant- accused Devraj @ Deva for the offence punishable under Sections 8/20 of N.D.P.S. Act, 1985 in Case Crime No. 379 of 2024, Police Station- Sector-20, District-Gautam Budh Nagar. 2.Mr. Pravin Kumar Mishra, learned advocate, appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case, wherein he has been apprehended by the police on the basis of tip off while he was sitting in park and two bags have been recovered from the possession carrying 30 and 20 kgs. of Ganja respectively. The arrest and recovery of the accused has not been made in the presence of independent witness. The mandatory provision of Section 50 N.D.P.S. Act has not been complied.
