The present bail application has been moved by the applicant- accused Sahab Raj Yadav for the offence punishable under Sections 8/20/29 of N.D.P.S. Act, 1985 in Case Crime No.54 of 2024, Police Station- Jangipur, District- Ghazipur. 2. Sri Priya Ranjan Rai, learned counsel appears on behalf of applicant and submits that the accused-applicant has been falsely implicated in the present case, the recovery of 83 kg. 550 gram ganja from the joint possession of two accused persons including the applicant. The charge sheet has been submitted against the applicant. The criminal history of four cases are shown against the accused-applicant, in which he is on bail. The arrest and recovery of the accused has not been made in the presence of independent witness. The mandatory provision of Section 50 N.D.P.S. Act has not been complied.
