The present bail application has been moved by the applicant- accused Farman Khan for the offence punishable under Sections 8/22 of N.D.P.S. Act in Case Crime No. 470 of 2024, Police Station- Tilhar, District-Shahjahanpur. 2. Sri Ali Hasan, learned advocate appeared for the applicant and submitted that the accused has been falsely implicated in the case wherein two bundles of contraband weighted 280 gms and 407 gms have been confiscated from the possession of the accused applicant in absence of the independent witness. The sample has not been gathered from the two different bundles. There is no criminal history of the accused applicant. The accused applicant has been apprehended by the police on the basis of tip off. It is further submitted that the mandatory compliance of Section 50 of the N.D.P.S. Act has not been carried out.
