Hon'ble Sanjay Kumar Singh,J. 1-Heard learned counsel for the applicant, learned Additional Government Advocate representing the State and perused the record. 2-The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 382 of 2025, under Section 8/20 of N.D.P.S. Act, Police Station Nandgram, District Ghaziabad, during the pendency of trial. 3-It is submitted by learned counsel for the applicant that the applicant is being prosecuted on account of recovery of 1 Kg and 100 grams of Ganja from his possession. In fact, nothing has been recovered from the possession of the applicant as alleged by the prosecution. It is further submitted that alleged recovery of 1 Kg and 100 grams of Ganja is below commercial quantity, therefore, provisions of Section 37 of N.D.P.S. Act is not attracted in this case.
