Present criminal appeal has been preferred assailing the judgement and order dated 12.9.1984 passed in Sessions Trial No. 23 of 1982 (State vs. Sureshpal Singh and another) convicting the appellant under Section 302 IPC and under Section 201 IPC and sentencing him to life imprisonment and one year R.I. respectively and sentences to run concurrently. 3. The prosecution story, in brief is that on 23.10.81 Balak Ram, Chowkidar of the village Bhatiura, P.S. Sindhauli was heading towards Nagaria. At 8:00 am he came near Bahlolpur canal.
