Present writ petition is filed by petitioner praying that opposite party no.2 may be directed to Appeal bearing Case no.28021 of 2022 (Computerized Case no.202205310328021), "Simmi Sonkar vs. Naib Tehsildar Nagar" filed under Section 35(2) of U.P. Revenue Code, 2006, which is pending since the year 2022 and has not been decided till date. 3. Learned counsel for the petitioner submits that grievance of the petitioner would be sufficiently met in case opposite party no.2 considers and decides the aforesaid case in a time bound manner. 4. Looking into the facts and circumstances of the case, without entering into the merits of the case, opposite party no.2-Sub Divisional Magistrate, Sadar, District Gorakhpur, is directed to proceed with Appeal bearing Case no.28021 of 2022 (Computerized Case no.202205310328021), "S
