After arguing at some length the learned counsel for the petitioner prayed that he may be permitted to avail the statutory remedy available to him under law. 2. The writ petition is accordingly dismissed with liberty as prayed. 3. Learned counsel for the petitioner has submitted that the impugned order shall have an adverse effect upon the proceedings initiated, if any. It is clarified that the summary proceedings are not decisive of the rights of succession, therefore, the competent court having jurisdiction shall proceed on the own merit of the case and without prejudice on the basis of order passed by this Court.
