Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed challenging the orders passed by the Mutation Court. Petitioner has lost from all the three Courts and the Will set up by the petitioner has been disbelieved by the Courts below. The Will has been executed in favour of grandsons excluding the sons of deceased. The Courts below have recorded a finding of fact that the Will has not been proved. 3. Since the mutation proceedings are summary in nature and are only for fiscal purposes, rights and title of the parties are not decided. 4. In view of the same, I am not inclined to interfere with the order passed by the Mutation Courts. 5. Accordingly, the writ petition stands disposed of with liberty to the petitioners to establish their case by filing a declaratory suit under the relevant provisions of law.
