Brief facts of the case are that in the proceeding under Section 34 of the U.P. Land Revenue Act, 1901, an order dated 3.11.1993 was passed by Tehsildar for recording the name of petitioners on the basis of registered will deed. Against the order dated 3.11.1993, restoration proceeding initiated at the instance of respondent no.6 is pending. Petitioners challenged the order dated 1.5.1995 by two appeals which were registered as case No. 38 and 39. The aforementioned appeal were dismissed vide order dated 8.7.1996.
