The stand in the written instructions, that has been produced by the learned Additional Chief Standing Counsel, is that the fact that the petitioner's land was converted from Class-6 to Class-5 is not at all clear inasmuch as between Fasli 1365-66 and Fasli 1392, no Khatauni is available on account of which it cannot be discerned as to who passed an order, if at all, converting the land category from Class-6 to Class-5. 2. Learned Standing Counsel submits that land of Class-6 would be public utility land, in which no Bhumidhari rights can accrue whereas Class-5 is land i.e. Navin Parti or Banjar wherein a patta can be granted. The petitioner's case is that it is in fact Class-5 land wherein the petitioners were granted a patta way back in the year 2000 & 2011.
