Hon'ble J.J. Munir,J. 1. The petitioner essentially seeks relief against encroachment over his agricultural land by private respondents. All that he says is that it is with the connivance and assistance of the Consolidation Officer, Lalitpur and the Chakbandi Lekhpal, Village- Aira, Teshil and District- Lalitpur. 2. Assuming that what the petitioner says is right, the cause of action involved is essentially under the private law with no element of violation of any public right or breach of public duty involved. 3. This writ petition is, therefore, held not maintainable but with the remark that it shall be open to the petitioner to institute a suit for such relief before a Court of competent jurisdiction as advised on the same cause of action.
