Hon'ble J.J. Munir,J. The impugned order is one passed by the Settlement Officer of Consolidation, Sambhal in proceedings arising out of Section 9- A(2) of the U.P. Consolidation of Holdings Act, by which he has set aside the order of the Consolidation Officer and remitted the matter to the Court of first instance. For one the order impugned is an order of remand against which a petition under Article 226 of the Constitution, is seldom to be entertained. There are no exceptional circumstances obtaining in this case. The other is that the order impugned, in any event, is revisable under Section 48(1) the U.P. Consolidation of Holdings Act before the Deputy Director of Consolidation. There being a clear and established equally efficacious alternative remedy, this petition cannot be entertained on double count; of course, without prejudice to the case of parties, which the petitioner may suit before the authority of competent jur
