Brief facts of the case are that proceeding under Section 34 of the U.P. Land Revenue Act, 1901 was initiated on behalf of the petitioner on the basis of unregistered will deed dated 13.1.2001 executed in his favour by deceased Sher Singh. Naib Tehsildar vide order dated 21.6.2001 allowed the mutation application of the petitioner directing to record the name of petitioner over khata No. 61 khasra No. 479 area 2.036 hectare and khasra No. 480 area 2.061 hectare total area 4.097 hectare.
