However, learned counsel for the parties agree that the entire loan amount which was paid to the petitioner has since been recovered and nothing is recoverable from the petitioner. In that view of the matter, the present Writ Petition is rendered infructuous and is accordingly disposed of. The application filed seeking amendment of the petition (IA.No.3 of 2022), in our opinion, gives rise to a fresh cause of action which may be 2 HCJ & RC,J WP_27041_2021 challenged in an appropriate proceeding independently, if so advised.
