Submission has been made that the land in question, which is recorded as 'Khalihan', a park is being set up by the respondents and therefore, they be restrained from using the land in question as park. 3. We have considered the submission made by counsel for the petitioner and perused the material available on record. 4. Admittedly, the land of 'Khalihan' is a public utility land and setting up of a park by the respondents, is also for the purpose of public utility only and as such, the action of the respondents cannot be faulted. 5.
