Judgment text excerpt

Neutral Citation No. - 2025:AHC-LKO:4484-DB Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 52 of 2025 Petitioner :- Shyam Bihari Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 5 Others Counsel for Petitioner :- Shesh Mani Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J. 1. The repeated exercise in the present PIL is not satisfactory for maintaining a cause in public interest. Mere mention of names in the representation without disclosure of the land holding belonging to each one of the persons, who are stated not to be subjected to the consolidation proceedings with respect to their land holdings, in our view does not conform to the requisite criteria within which attempt of instituting litigation for public cause can be said to have been met with. The petitioner has again adopted a callous approach thus we are not inclined to entertain the present writ petition against the notification issued under the U.P. Consolidation of Holdings Act, 1953 though at a belated stage. 2. The petition is accordingly dismissed. Order Date :- 23.1.2025 Pradeep/- Digitally signed by :- PRADEEP SINGH High Co
