Heard learned counsel for the parties and perused the record. 2. The present writ petition has been filed by the petitioner with the following prayer :- "(i). Issue writ, order or direction in the nature of mandamus commanding and directing the opposite party no. 2 to 4 to remove the illegal encroachment on public utility land i.e. 53/2.6190 hectare (encroached by constructing house over area 100 Sq.M. i.e. 0.0100 hectare) situated at Village Pure Pandit, Pargana Suryapur, Teshil Ramsanehighat, District Barabanki which is recorded as Pond in the interest of justice." 3. Learned Standing counsel based upon the instructions states that certain unauthorized constructions are existing for which proceedings have already been initiated under Section 67 of the U.P.
