This petition inter alia has been filed by the petitioner seeking direction to the respondents to remove the illegal encroachment of Respondent no.6 from the land in question which, it is claimed, though is custodian land, the same has been got fraudulently mutated in the name of Respondent no.6. 2. Once the case of the petitioner is that the land in question stands mutated in the name of Respondent no.6, filing of the Public Interest Litigation seeking an action against Respondent No.6 for alleged encroachment cannot be maintained. 3. The petitioner first has to take steps for rectification of the record which, it is claimed, has been fraudulently altered and thereafter seek the relief as claimed in the writ petition. 4.
