Heard learned counsel for the petitioner and learned Standing Counsel. 2. The present petition has been filed with the following prayer:- "i) Issue, a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite party No. 2 & 3 to remove the illegal encroachment over the Pond Land bearing Gata No. 170 Area 0.0890 Hectare situated at Village- Aalhemau, Pargana-Mohammadpur, Tehsil-Fatehpur, District- Barabanki and initiate the proceeding under section 67 of U.P. Revenue Code, 2006 and take appropriate action against the private respondent/ encroacher, in the interest of justice." 3. Learned Standing Counsel, based upon the instructions, states that the offending constructions have already been removed. The instructions are taken on record. 4. In view thereof, no further orders are required to be passed.
