The instant application has been filed seeking release of the applicant on bail in Case Crime No. 280 of 2024, under Sections 103(1), 109, 115(2), 352, 117(2) BNS, Police Station- Ubhaon, District- Ballia, during pendency of the trial in the court below. 3. FIR of the present case was lodged against applicant and co- accused Mantu on 20.09.2024 and according to FIR, applicant and co-accused Mantu made assault upon the informant. 4. Learned counsel for the applicant submitted that initially with regard to an incident, informant of the present case lodged a NCR against applicant and co-accused Mantu on 31.07.2024 and when informant died on 27.09.2024 then NCR lodged by him has been treated as FIR. 5.
