The instant application has been filed seeking release of the applicant on bail in Case Crime No. 276 of 2024, under Sections 3(5), 61(2), 103(1) BNS, Police Station- Sadar Bazar, District- Mathura, during pendency of the trial in the court below. 3. FIR of the present case was lodged on 16.10.2024 against applicant and others and according to FIR, brother of the informant resided in a house where applicant and others also resided and on 13.10.2024, applicant and other accused persons threatened his brother and subsequently, in the night, they have committed his murder. 4. Learned counsel for the applicant submitted that it is a case of circumstantial evidence and admittedly, no one could see the real incident and it appears that on the basis of suspicion, applicant has been made accused
