The present bail application under Section 439 Cr.P.C. has been filed on behalf of applicant Atul Singh with a prayer to release him on bail in Sessions Trial Case No. 990 of 2023 arising out of Case Crime No. 763 of 2015 under Section 2/3 Uttar Pradesh Gangsters and Anti Social Activities (Prevention) Act, 1986, registered at Police Station Gajraula District Pilibhit, during pendency of the trial. It has been submitted by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case due to ulterior motive. Learned counsel for the applicant submits that initially the applicant was on bail, but due to non appearance before the Court below, he has been summoned through non bailable warrant of arrest. On coming to know about
