First bail application of the applicant was rejected by this court on 09.02.2023. There are allegations against the applicant and co-accused of committing the offence of rape and murder of a girl. Learned counsel for the applicant submits that in the FSL report swab sample of the vagina of deceased and the blood sample of the applicant has not matched. He has been falsely implicated in this case on the allegation of throwing the dead body of deceased. It is a case of circumstantial evidence. Even otherwise applicant is in jail since 31.12.2021 and has no criminal history to his credit. Learned AGA has opposed the prayer for bail but could not dispute the above submissions.
