In the prosecution case, it is alleged that on the basis of information given by the informer, police had apprehended the applicant and other co-accused persons at Mathuranagar Tola and from their possession, in a plastic bag, 369 caps of McDowell and 845 caps of English liquor etc. have been recovered. Learned counsel for the applicant submits that nothing has been recovered from the possession of the applicant as has has been alleged in the FIR. False recovery of duplicate caps of three brands of English Liquor have been shown from the possession of the applicant by the police as there is no independent eye witness to the said recovery. Offences are triable by the Magistrate. Apart from this case, applicant has no criminal history. Applicant is languishing in ja
