Hon'ble Sanjay Kumar Singh,J. 1-Heard learned counsel for the applicant and learned A.G.A. representing the State. 2-The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 365 of 2024, U/s 64(1), 89 B.N.S., Police Station-Ahirauli Bazar, District-Kushinagar. 3-It is argued by learned counsel for the applicant that on account of ill-will, applicant, who is next door neighbour of the informant, has been falsely implicated in this case making allegation inter-alia that his daughter, aged about 24 years, is a mentally retarded since her childhood. The applicant, who is aged about 50 years, alluring the victim has been making physical relation with her for the last two years whereas the said allegation is not corroborated from any material evidence as father of the victim has refused for internal examination of the victim.
