The present bail application under Section 439 Cr.P.C. has been filed on behalf of applicant, Rajendra Giri with a prayer to release him on bail in Case Crime No. 27 of 2024 , under Section 8/20b (ii) C of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Partapur , District- Meerut . Learned counsel for the applicant has contended as per the FIR version, the recovered truck belongs to the applicant. In fact, the said truck has no concern with the applicant. One Sanjay has submitted an application for release of vehicle before the Court below and the learned Court below vide order dated 19.3.2024 (annexed as Annexure-SA) released the said vehicle in favour of said Sanjay.
