This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant seeking enlargement on bail in Case Crime No.469 of 2023, under Sections 302, 307, 504, 34 IPC, Police Station Link Road, District Ghaziabad. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case due to ulterior motive. The impugned FIR is delayed about 15 days. Initially the impugned FIR has been lodged under Section 307 and 506 IPC but after the death of the deceased, Section 302 IPC was added. As per allegation, the applicant and co-accused have assaulted the deceased by knife and during treatment, the injured died.
