The instant bail application has been filed by applicant to enlarge him on bail in Case Crime No. 16 of 2023, under Sections 364A, 302, 201, 34, 419, 420 IPC, P.S.- Behelupur, District- Varanasi. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case mainly on the ground that ATM card of the deceased (Mahmood Alam), has been recovered from the pocket of the applicant while he was going through the car along with co-accused persons. It is further submitted that there is no public witness of the alleged recovery and entire case is based on circumstantial evidence and till date, out of 52 witnesses only 2 witnesses could be
