This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Shahrukh, seeking enlargement on bail in Case Crime No.288 of 2024, under Section 8/20 N.D.P.S.Act, Police Station Mainather, District Moradabad. It has been submitted that the applicant is innocent and has been falsely implicated in this very case. The applicant was arrested on 16.08.2024 and 1 kg 75 grms charas and some money was recovered from his possession. It is alleged that the recovery of the contraband from the possession of the applicant is planted one. It is argued that mandatory provisions of Sections 41, 50, 52A of the N.D.P.S. Act have not been complied with
